A foreign manufacturer of tractors, harvesters, irrigation systems, greenhouse equipment, agricultural drones, or soil and crop sensors approaching the Japan market faces two questions that are easy to conflate but must be answered separately. The first is a customs structuring question: who appears as the legal importer on the import declaration (輸入申告)? The second is a biosecurity question that has nothing to do with customs structure at all: does the equipment trigger a plant quarantine inspection because it has been in contact with soil, plant material, or agricultural residue? Manufacturers who treat agricultural machinery as a subset of general industrial machinery import routinely miss the second question, and it is the one most likely to cause a hold at the port.
The Compliance Layer That Generic Industrial Machinery Does Not Have
Standard industrial machinery, construction equipment, and factory equipment clear Japan Customs (税関) under the Customs Act (関税法) with an ordinary HS classification and duty assessment. Agricultural equipment carries an additional authority in the chain: the Ministry of Agriculture, Forestry and Fisheries (農林水産省, MAFF) exercises plant quarantine jurisdiction under the Plant Protection Act (植物防疫法) over goods capable of carrying soil, plant pests, or plant material residue.
This is not a theoretical risk specific to used equipment. Any of the following can trigger a plant quarantine inspection, new or used:
(a) tractors, harvesters, and tillage equipment with soil adhering to tires, tracks, undercarriage, or attachments;
(b) irrigation and greenhouse equipment that has been in field use and retains organic residue in hoses, filters, or housings;
(c) used farm machinery parts shipped without prior cleaning, where packing material itself (straw, wood pallets, plant-based dunnage) can independently trigger inspection under separate wood-packaging and plant-material rules;
(d) agricultural drones and soil or crop sensors that have been field-deployed and returned with adhered soil on landing gear, rotors, or sensor housings.
The plant quarantine inspection is a separate regulatory event from the customs import declaration. It can result in a hold, a mandatory cleaning or fumigation order, or in the worst case a refusal of entry, independent of whether the customs side of the shipment (classification, valuation, importer structure) is entirely correct. A shipment can clear the customs declaration cleanly and still sit at the port because MAFF has not released it. Manufacturers and their logistics teams frequently treat this as a documentation formality; it is a substantive inspection with its own hold authority.
Practical implication: for any shipment involving equipment with prior field use, cleaning and inspection should happen before the goods leave the country of origin, not after arrival in Japan. A pre-shipment cleaning certificate does not guarantee release, but arriving with visible soil or plant residue makes an inspection hold close to certain.
The Customs Structure Question: Who Is the Importer
Once the plant quarantine question is addressed, the underlying customs structure question is the same one that applies to any non-resident manufacturer selling into Japan without a Japan entity. IOR (Importer of Record)
Under this structure, Aplash is the legal importer. Aplash purchases the equipment from the overseas manufacturer, clears customs in its own name as the entity named on the import declaration, and re-sells to the Japan buyer, whether that buyer is a distributor, a cooperative, or an end-user. Aplash issues a qualified invoice (適格請求書) to the Japan buyer, which allows that buyer to recover Japan Consumption Tax (JCT) as input credit. This structure suits a manufacturer that wants a Japan-side counterparty to take on full importer liability, including the coordination of the plant quarantine clearance, rather than appearing on Japan customs records itself.
ACP (Attorney for Customs Procedures / 税関事務管理人)
Under this structure, the foreign manufacturer remains the legal importer named on the import declaration. This option is available only when the manufacturer is a non-resident of Japan, with no Japan address, residence, or office, under the framework of Customs Act Article 95 governing customs procedure attorneys for non-residents. The choice between these two is not determined by whether the manufacturer prefers one label over the other; it is determined by whether the manufacturer wants to appear on Japan customs and quarantine records directly (ACP) or wants a Japan-resident buy-and-sell counterparty to carry that role (IOR).
Category-Specific Due Diligence
Three points are specific to agricultural equipment and worth flagging before a shipment is booked.
Used and second-hand equipment. Second-hand tractors, harvesters, and attachments carry materially higher plant quarantine risk than new equipment straight from a factory line, because prior field use is the primary source of soil and plant residue contact. A pre-shipment cleaning protocol, ideally documented with photographs or a cleaning certificate from the exporting country, reduces the likelihood of a hold. This is a due diligence step the manufacturer or exporter controls before the goods are ever presented to Japan Customs or MAFF; it cannot be remedied after arrival without cost and delay.
HS classification nuance. Agricultural machinery does not always classify the same way as functionally similar general industrial machinery. Tractors, harvesters, and dedicated agricultural implements sit under headings distinct from general-purpose earthmoving or materials-handling equipment, and misclassification is a common source of duty and quarantine-flagging errors. Classification should be confirmed against the actual tariff schedule for the specific model and configuration rather than assumed by analogy to a general machinery category; this is a standard part of the IOR or ACP onboarding review and should not be treated as a formality.
Buyer profile. The commercial buyer for agricultural equipment in Japan is frequently different from the buyer profile for general industrial machinery. Common counterparties include agricultural cooperatives (including JA group entities), prefectural agricultural equipment distributors, and individual large-scale farm operators. None of these buyer types changes the customs or quarantine analysis, but they do affect commercial terms, after-sales expectations, and the volume and frequency of the parts supply chain discussed below. Any specific buyer relationship, distributor arrangement, or purchase volume referenced in a manufacturer's own market materials is that manufacturer's claim about its own business and should be verified independently rather than treated as established fact by Aplash.
After-Sales and Parts Supply
Agricultural equipment has a long service life relative to many categories of industrial goods, and manufacturers typically expect an ongoing parts and service pipeline into Japan for years after the initial equipment sale. This has two structural consequences worth planning for before the first shipment lands.
First, the customs structure chosen for the initial equipment import (IOR or ACP) does not automatically extend to future parts shipments; each shipment is assessed on its own terms, though a standing IOR or ACP relationship reduces onboarding friction for repeat shipments. Second, replacement parts can themselves carry plant quarantine exposure if they arrive with residual soil, packing material, or have been removed from field-used equipment as part of a trade-in or refurbishment arrangement, so the "new parts only" assumption should not be applied without checking sourcing history. For a manufacturer approaching the Japan market without a Japan entity, the practical sequence is:
(a) confirm whether the specific equipment or parts shipment carries plant quarantine exposure (any prior field contact with soil or plant material, wood packaging, used equipment) and arrange pre-shipment cleaning or documentation accordingly;
(b) confirm HS classification for the specific model against the actual tariff schedule rather than by analogy to general industrial machinery;
(c) decide, separately from the quarantine question, whether the manufacturer wants to remain the named importer via ACP or have a Japan-resident buy-and-sell counterparty take that role via IOR;
(d) identify the intended Japan buyer type (cooperative, distributor, or individual operator) early, since it affects commercial terms though not the regulatory structure; and
(e) plan the parts and after-sales pipeline as a recurring structural question, not a one-time shipment decision.
